Abstract: The Central Government, along with all State Governments, was consulted regarding the protection and conservation of forests in India, leading to a hearing involving various legal experts. After extensive discussions, the court concluded that a more in-depth hearing is required to address all aspects of the National Forest Policy. However, interim directions were deemed necessary, particularly regarding the Forest Conservation Act, 1980.
A key point of contention emerged regarding misconceptions about the scope of the Act, especially concerning the term “forest” and the need for prior approval from the Central Government for certain activities, often commercial, in forest areas. The court clarified that the Forest Conservation Act applies to all forests, regardless of ownership or classification, and the term “forest” should be understood in its broad, dictionary definition. This interpretation encompasses all recognized forests, whether reserved, protected, or otherwise, and applies to any land recorded as forest in government records. The court emphasized this understanding, referencing previous decisions to clarify any doubts and urging state governments to correct any misconceptions, especially in cases like the mining permissions granted by Rajasthan. States failing to align with the legal framework were directed to take immediate remedial actions.
